Assessment of the damages for pain and suffering

In case of relatively light injuries connected with a long pain period the assessment of the amount of compensation for pain and suffering is particularly difficult. In such case the requirements for the cost privilege pursuant to § 43 Article 2 ZPO with respect to the claim for damages for pain and suffering can be affirmed (RIS-Justiz RS0035903).
